Department of Administration Announces Leadership Change at Office of Public Defender
HELENA, Mont. – Department of Administration (DOA) Director Misty Ann Giles today announced that Koan Mercer will replace Brett Schandelson as Director of the Office of Public Defender (OPD).
“Schandelson’s work during his time at OPD was highly impactful and effective,” Director Giles said. “We look forward to the skill set Mr. Mercer will bring to this role, while having continued assurance that all Montanans’ constitutional right to counsel will be protected as we work with him in the future.”
“Thanks to the dedication of the OPD team and under Brett’s leadership, the office was able to build lasting systems for better public defense in Montana,” Gov. Gianforte said. “I am grateful for Brett’s eight years of service to the state and look forward to Mercer filling the role to continue as a strong defender of the constitutional rights of Montanans.”
Schandelson served OPD for nearly eight years, beginning as Development and Operations Bureau Chief before stepping into the Director role in 2022. In October 2025, DOA announced Schandelson’s departure to explore new opportunities.
Mercer earned his law degree from the University of North Carolina in 2004 and joined OPD in 2006, most recently serving as the agency’s central services division administrator.
“OPD is grateful for Brett’s leadership and service,” Mercer said. “I’m excited to continue the vital work of OPD and look forward to serving the people of Montana in this important role.”
Mercer’s first day serving as OPD Director will be January 12, 2025.
