HELENA – The Montana Department of Environmental Quality is accepting comments on a draft hazardous waste permit modification for the former BNSF railroad tie treating plant in Paradise, Mont.
The draft hazardous waste permit modification includes removal of two permitted storage tanks, changing the creosote product recovery method to an air-lift pump recovery system and modifying the groundwater monitoring program.
The draft hazardous waste permit modification, a draft environmental assessment and a fact sheet are available for review at the Plains Public Library, 108 W. Railroad St., Plains, and DEQ’s Metcalf Building, 1520 E. 6th Ave., Helena. The documents are also at: http://www.det.mt.gov/Public/publiccomment
Only the changes proposed in the permit modification are open for public comment. During the public comment period, any interested person may request a public hearing. A request for a public hearing must be in writing and state the nature of the issues proposed to be raised in the hearing. If a public hearing is held, DEQ will provide notice of the date at least 30 days prior to the hearing.

Based on the comments received, DEQ will make a final decision to issue or deny the permit modification. Notice will then be given to BNSF and anyone who submitted written comments or requested a notice of the decision. The final decision will become effective 30 days after the service of notice of the decision, unless a later date is specified by DEQ. If no comments are received, the final decision becomes effective immediately upon notice of DEQ’s final decision.
